Climate Dialogue is a platform for open and rational discourse on some of the most important albeit contentious issues on climate governance in Canada. It brings together stakeholders with varying viewpoints to address contentions and craft solutions. I’m excited to share that I have successfully completed the Online Course on Climate Change International Legal Regime under the auspices of the United Nations Environment Program (UNEP), the United Nations Institute for Training and Research (UNITAR), and InforMEA. Yale and Columbia Universities collaboratedand produced the World Environmental Protection Index. The 2022 EPI supports evolving climate policy discussions with a new indicator that projects countries’ progress towards net-zero emissions in 2050. Funded and Canadian Government support, found: "First, good policy results are associated with wealth (GDP per capita), meaning that economic prosperity makes it possible for nations to invest in policies and programs that lead to desirable outcomes. Second the data suggest countries need not sacrifice sustainability for economic security or vice versa. Third, the data further suggest that countries making concerted efforts to decarbonize their electricity sectors have made the greatest gains in combating climate change, with associated benefits for ecosystems and human health. .. Last week, numerous States, international organizations and civil society organizations submitted written observations in the historic proceedings before the International Court of Justice (ICJ), pursuant to the United Nations General Assembly’s request for an advisory opinion on the obligations of States in respect of climate change.   Much appreciation for the tremendous leadership of Vanuatu, in particular, and the powerful work of student and youth campaigners across the world, esp. Pacific Islands Students Fighting Climate Change and World's Youth for Climate Justice (WYCJ)!   The Center for International Environmental Law (CIEL) written submission focused on four key areas:   📚 Applicable Law ⚖ Climate reparations 🛢 Urgent and equitable phase-out of fossil fuels 🚸 The Rights of Future Generations   [Our submission & it’s four distinct sections can be accessed at: https://lnkd.in/ezcWPiTE]   The ICJ climate advisory proceedings now enter the critical comments period where States and international organizations may submit written comments on other written statements by 24 June 2024. This is a vital window of opportunity to counter legal positions which undercut a climate justice approach, and to reinforce progressive arguments. Throughout 2024, significant legal actions have strengthened the case for governments and fossil fuel producers to address the urgent #ClimateCrisis. Recently, United Nations Member States gathered for what’s called the “Fifth Montevideo Programme,” identifying key areas to tackle this global challenge through legal channels. In this context, UNEP launched the Law and Environment Assistance Platform, a resource hub providing easy access to environmental news, laws, court decisions, model laws, and practical guides. 🌍 ⚖ Much awaited news-the International Tribunal for the Law of the Sea/Tribunal international du droit de la mer (ITLOS) will deliver its advisory opinion on climate change at a public sitting on 21 May 2024 at noon. This follows the December 2022 Request for an Advisory Opinion submitted to the Tribunal by the Commission of Small Island Commission of Small Island States on Climate Change and International Law. In essence, the Tribunal has been asked to clarify (a) whether greenhouse gas emissions qualify as marine pollution, and if so, what are the obligations of State Parties to the United Nations Convention on the Law of the Sea (UNCLOS) to prevent, reduce and control such pollution under international law, and (b) the obligations of these countries to protect and preserve the marine environment from climate change impacts. #Oceans play a crucial role in climate mitigation and adaptation. A strong, progressive advisory opinion from ITLOS would provide meaningful and unambiguous guidance to State Parties regarding their legal obligations under the law of the sea, understood in light of their duties under international human rights law and other relevant international law, to protect the oceans. Such an outcome would be a critical step to effectively safeguard marine ecosystems, address the climate crisis, and uphold human rights, and raise the bar for the other ongoing climate advisory proceedings before the Inter-American Court of Human Rights and the International Court of Justice (ICJ). #climatechange #advisoryopinion #AOLetsGo #ClimateRulings
