In the first episode of Elsbeth, an awesome spinoff of The Good Wife, a crime is solved (spoiler alert coming -) thanks to a text message analysis. As I'm quite obsessed with writing well and being clear with one's messaging, I found it really interesting. Then I realised I am acting just like that criminal - I too use double space between sentences/paragraphs in my whatsapps. Elsbeth says in the show this is how "older people" communicate. Can't argue there - younger people tend to communicate without a breather, they speak fast and swallow words and write similarly. But it doesn't matter how old you are, and if you're a criminal or an innocent innovator, add some spaces on all forms of messaging in order to be clear. #storytelling #messaging CBS

Cited from Burks v. United States, 437 U.S. 1, 11; I've yet to find a case wherein this "Clause" applied to the circumstances concerning a hung-jury. Manifest necessity should not be taken into account when the prosecution wants to take a second bite of the fruit - from a poisonous tree (it's a metaphor that legal minds should not immediately refer to material requiring suppression; it's more like a fabrication of - if not blatantly false - evidence). The Double Jeopardy Clause forbids a second trial for the purpose of affording the prosecution another opportunity to supply evidence which it failed to muster in the first proceeding.[6] This is central to the objective of the prohibition against successive trials. The Clause does not allow "the State . . . to make repeated attempts to convict an individual for an alleged offense," since "[t]he constitutional prohibition against `double jeopardy' was designed to protect an individual from being subjected to the hazards of trial and possible conviction more than once for an alleged offense." Green v. United States, 355 U. S. 184, 187 (1957); see Serfass v. United States, 420 U. S. 377, 387-388 (1975); United States v. Jorn, 400 U. S. 470, 479 (1971).
If you like crime dramas about hung juries (such as “Twelve Angry Men”), here’s one you probably haven’t seen before — and it’s worth watching. In this 1963 episode of TV crime drama “Naked City,” a Manhattan business executive and his girlfriend are on trial for the murder of his wife. There is just one holdout on the jury: a Greek immigrant who is not convinced of their guilt because the wife’s body was never found. He argues that without a body, there is no proof there was a murder. The holdout’s persistence results in a verdict of “not guilty.” But the next day, evidence is found that the victim’s body was dumped in the ocean. The holdout juror (who owns a news stand), seeing the headlines about the new evidence, is emotionally shattered — and goes about seeking his own form of justice. Lots of interesting discussion about “reasonable doubt” and “double jeopardy” here. Well worth 50 minutes of your time.
