Protecting workers right is always an important topic. However, this new rule has the potential to send employers on a journey of rough seas. Workers will now be able to designate a non-employee as their representive during an OSHA inspection, and that representive will be permitted to walk the site with the OSHA inspector as long as that representitive can provide value to the inspection. This would mean a disgruntled worker, an injured employee, or a whistleblower who has contacted OSHA and sparked an investigation/inspection could very well designate their bilingual personal attorney to be their representive. Under this new rule, anyone could be designated as an employee representive and gain free access to the site which poses a number of risks. Site security, trade secrets, worker confidentiality, owner rights, with this new final rule…these things all hang in the balance.
