#Truestory it happend to me about two years ago - and a little small detail saved the day.. If a client doesn't (want to) pay an invoice. even if the deliverable is there, even if the made a ton of money from it... Some will resort to... lies, twists, turns, ghosting, stalling, go silent, shout, pretend they forgot, blame you, and threaten. And if you are unlucky, once in a while... you may run into one that does all the above. 👀 Fat chance that any discussion or logical argument is going to change their mind, especially if they are low on cash. The realisation that someone will lie, that didn't even occur to me before. This is one of those moments that you want to have a clear as possible contract, and don't give in to the BS. As a tip make sure you have a paragraph in general term that addresses "Failure to fulfill obligations by client" in that you are able to suspend work untill invoice is paid. Otherwise you may end up working for zero, but still be obliged to do the work or get sued. I am no lawyer, but that is brutal. Let's talk about something that's been on our minds lately. As a Business Owner how do you react when someone asks you to lower your prices or cut them a deal for the services or product you provide, whilst still offering the same level of service and expertise? 🤔 Sure, there are times when it's a reasonable question, and you can be open to making the odd concession but when it becomes a consistent trend, it's time to pause and ponder, isn't it? 🧐 After all, maintaining quality and output whilst reducing prices isn't always feasible. So, where do you draw the line? Providing Legal guidance and expertise across Terms & Conditions, Contracts, Debt recovery, Will and LPA’s requires extensive knowledge of the law and how it impacts Business. Keeping up to date on the latest changes or requirements takes time as does ensuring all of our clients remain compliant as they grow. However, over recent months we have seen an increase in enquiries where a client have found themselves in hot water and need support urgently. Whilst we always look to be as responsive as possible, often these calls have come with unrealistic expectations over the timeframes it may take to review and advise on a situation but then also the costs of seeking the expertise they need. We pride ourselves on providing transparent and competitive fees (in some circumstances fixed fees or monthly subscriptions) and therefore to find yourself almost having to negotiate or defend your pricing structure, leaves you questioning whether the other party then is happy with you providing half a service. I think we all know the answer to that question! Got a contract? Let's go through the (presumably) most important clauses - transaction, consideration, timelines, .... Seems alright. Let's sign. Day-to-day sighting in legal profession. Beware. The Proverbial Devil lies in Details. Reading a contract in its entirety is crucial for several reasons, and ignoring it can lead to various problems, ranging from financial strain to legal disputes. Here are some aspects: Understanding your rights and obligations. Contracts outline the expectations and responsibilities of all parties involved. By skimming or skipping sections, you may miss crucial details about what you're entitled to, what's expected of you, and potential limitations. This could lead to unexpected financial burdens, missed opportunities, or even violations of the contract. Hidden issues / fine print. Contracts often contain "fine print" clauses tucked away in less obvious sections. These might include automatic renewal / termination clauses, non-compete, or unexpected damages / charges / fees. Missing these could put you in a disadvantageous position later. Misunderstandings. Assumptions can be dangerous. By reading everything, you get a clear picture of the contract, reducing the risk of misinterpretations and future disagreements. Disputes. When disputes arise, a clear understanding of the contract strengthens your position. If you haven't reviewed it thoroughly, you might lack evidence to support your claims, making it harder to resolve the issue fairly. Legal Protection. Executing a contract binds you to its terms and conditions. By not reading it fully, you waive your right to challenge unfair or unclear clauses at a later stage. This could leave you legally vulnerable in case of a breach. Here are some potential problems you might encounter if you ignore reading a contract completely: Financial loss.
