TikTok does not escape the DMA dance; the General Court dismisses the challenge of its gatekeeper status The General Court emphasized in its judgment of 17 July that the Digital Markets Act has the purpose of contributing to the proper functioning of the internal market and its fairness in general. The Commission was fully entitled to consider Bytedance, the parent company, as a gatekeeper under the DMA. The Court rejected the arguments made by Bytedance for the following reasons: Bytedance’s high global market value, together with the large number of Tiktok users in the European Union, reflects its financial capacity and its potential to monetise those users; Tiktok has increased the number of its users rapidly and exponentially gaining, over a short period of time, half the number of users as those of Facebook and Instagram, with a particularly high engagement rate; Although in 2018 TikTok was a challenger seeking to contest the position of established operators such as Meta and Alphabet, it has rapidly gained and consolidated its position, despite the launch of Reels and Shorts. As a gatekeeper, Bytedance is required to comply with the DMA. These rules aim to ensure that gatekeepers do not abuse their position. ICYMI: the latest move by the U.S. House Committee puts TikTok on the brink. If ByteDance doesn't sell, TikTok could vanish from the U.S. market, stripping millions of their platform for expression and disrupting businesses and creators alike. TikTok has over 160M US users and over 5M small businesses use the platform every day for entertainment, marketing, and to keep up with neutral discourse. As a creator or business owner, what should you do with this? Start to re-purpose all of your content to other platforms, including but not limited to Instagram, Facebook, YouTube, and Snapchat. Distribution is the name of the game. ByteDance said it's unlikely they will sell off TikTok in the US. Probably because ByteDance needs to get approval from the Chinese Regulator, and they'd hate to sell off their major asset (the tech soft power). The bill still has to be approved by the Senate and then signed by the US President. ByteDance can also challenge it in US courts, therefore progress may be delayed. Maybe some people in the US are trying to build another short-form video social networking app soon because of what is happening. Many months or years later, if TikTok is banned and a new app takes the market, people will be singing praise for their brilliant move. Or if TikTok is not banned and the new app dies, people will be saying 'Well what do they expect, TikTok will definitely find some way to come back'.
