Hey there, trademark fans. Stripes. They say they're swimming. Are they? Well, they may be swimming to your pocketbook if you're in an infringement suit. And what am I talking about? I'm talking about a case that just went by. Stripes for Adidas. Now Adidas was not the winner. You may not know that back in 1952. These moniker this, These Three Stripes bought for 2 bottles of whiskey in 1952 from a finished sportswear company. Wow. Well, drink up on that people. However, what am I talking about? Adidas who has come after a lot of people and companies for the three stripes, including places like Forever 21 or Ralph Lauren. And other companies for Three Stripes, in fact in the case that I'm talking about, they had referenced 200 settlement agreements that they have entered into. Now what are we talking about? We're talking about Tom Brown, which is a company that's a newer company from early 2000s, 2001 and their higher end price, they had changed from Three Stripes to four back in 2007 and their socks are higher priced, right 100 about $150.00 versus. You know, a couple pairs of Adidas for about 16 or $17.00, so big, big difference. And they added, you know, another stripe. So we see the difference in how they are looking and how they are being presented in their line. We see the four stripes on the socks. In fact the head of Tom Brown wearing his four stripes to the court, which is, you know, very bold, but bold enough that he, he won, you know, is very happy that a smaller company. One against a bigger company. Is it a win? It was an expensive win and we'll see about whether there'll be appeals or not. Did this also had challenged their mark in the EU and that didn't work. And when they got that registration as well. So sometimes the littler guy can win. It's costly. So what does that mean for you? What does it mean for your trademarks? Well, if you have something that's closely tied, doesn't mean they're going to win. It's going to cost you some money, it's going to cost you some time. But if you want to earn your stripes as a trademark person. Or a person who's protecting their brand aides all for it. And so with regard to stripes, I don't know, but I've been told that I like trademarks. Hot or cold. Yes, Bill Murray fans.
