I enjoyed speaking with E & E News for this story about the #MountainValleyPipeline case. It is currently before the Court on an emergency application to vacate the 4th Cir.'s stays. The basic question is whether Congress can delcare pending authorizations approved and then strip federal courts of jurisdiction to challenge the validity of the authorizations. In short, whether this violates the "Klein Rule of Decision" principle. This is, as all Klein cases are, tricky--Congress's action here looks both like an exercise of legislative power (setting substantive rules and adjusting jurisdiction) and an exercise of judicial power (resolving a dispute in favor of the government). Abolishing qualified immunity is critical to ensuring police accountability and upholding civil rights. Current protections shield officers from civil lawsuits for rights violations, even in fatal encounters. This creates a legal blindspot for families. Consider a scenario where the police unlawfully kill you, the primary breadwinner. Qualified immunity effectively eliminates the possibility of civil suits that could provide crucial financial compensation. This exacerbates the emotional trauma for your bereaved family, further jeopardizing their well-being. Immediate arrests and substantial sentences for officers convicted of murdering civilians are essential deterrents. Such measures demonstrate zero tolerance for egregious misconduct and ensure these officers are held legally responsible for their actions.

Important to include "fees on fees" in fee-shifting clause if you want to get fees for litigating fee issues!
On October 26, 2023 Justice Melissa A. Crane, of the New York County Commercial Division issued a decision in Newark Rehabilitation Ctr., PA v Simela, Index No. 651425/2022, 2023 NY Slip Op 33838(U), awarding plaintiff’s attorneys’ fees, but reducing the amount of fees after an inquest. First, the Court declined to award plaintiff’s attorneys fees incurred in making the fee application, holding that this would be an “impermissible award of fees on fees,” which “must be denied” “[a]bsent any statute or agreement allowing fees on fees,” which was not present in this case. The Court further reduced the remainder of the fees requested, finding that there were numerous instances of duplicative and excessive billing. See full link below: https://lnkd.in/efqv2rQU

In California, we are increasingly having a pay to play Public Records system, which goes against the spirit of public records. Departments charging $50 for calls for service logs, fees for looking up court indexes, etc. No recourse but finding an attorney to challenge if you are turned down. Media and private investigator leadership should really combine forces. How is your state for public records?
