A longterm concern that remains unsolvable. The DOJ has a goal to remove all compensation that may come from a Seller going to a Buyer’s Agent. Call it a concession, compensation, option, etc.; the Department of Justice has been working diligently towards eliminating the system that has been common practice for 50 years. On August 17th; Buyers who don’t have the means to pay their agent on top of down payment and closing costs will be relying on the modified system of Sellers still offering agent commissions. But it won’t be visible on the MLS. Some buyers will not be able to buy at all (VA loan programs, etc.). Appraisals, loan options to finance paying a buyer’s agent, accounting for no representation on a transaction, can be discussed forever but the ultimate loser will be the buyer. That will lead to higher costs for consumers. Side note: A Seller can deduct the costs to sell (including commissions) from their excess capital gains. A 3% commission may actually only cost 2% (or less). State and Federal tax agencies have a zero sum (or negative) when a property sells for less because of commission and lose money on the write off when the buyer pays. If this makes sense (or it doesn’t) and you are ready to sell; we should discuss all aspects of the sale process. Ask me.
