Great turnout at ALFI - Association of the Luxembourg Fund Industry London Conference today. Interesting takeaway from Financial Conduct Authority on the Regulatory panel that cross-border funds planning to distribute in the UK, contrary to press speculation, will NOT need a UK valuation assessment (at this stage). It seems that the Financial Conduct Authority are not planning on more barriers to entry, rather the opposite, recognising the importance of cross-border distribution and are looking to encourage not discourage! #alfilondon2023 #fca #crossborder #ukdistribution

#Event | One of the most inspiring events that our Managing Partner, Eliseo M. Martínez, had the privilege to attend was the "IBA Asset Recovery Conference" organised from 6-8 December at the Palais Hansen Kempinski in Vienna. For this reason, we would like to share our congratulations in early 2024 to Tomislav Sunjka, Sara Sheffield and the IBA Asset Recovery Committee for the comprehensive, useful and relevant content offered at their inaugural Conference held in Vienna, with 41 speakers and 18 jurisdictions represented. We were privileged to be joined by Lord Michael Briggs, Judge of the UK Supreme Court, whose closing remarks could not have been more pertinent when he mentioned that there should be no reason not to reach international agreement on effective tools to enforce against defaulting parties globally, at a time when UNCITRAL and the IBA are considering the relevance of developing a Model Law. ◾ Some of the highlights of the event were: How to get evidence in tricky places from tricky people. Tracing, recovering and preserving unique and difficult classes of assets. The case for an international model law on asset recovery. Interview with Lord Michael Briggs. SAS can exit Chapter-11, judge Wiles ruled at the Confirmation Hearing in a New York court today! A day to remember for SAS and its CEO Anko van der Werff. Judge Wiles ruling did not come as a surprise, as 99.9% of the creditors were in favour (or did not vote) on the debt restructure plan. The exit plan laid forth by SAS new owners, a Consortium lead by Castlelake, Danish State, AirFrance/KLM and Lind Invest, is solid enough and lead to judge Wiles with long experience on Chapter-11 cases, to approve it. In general 9 out of 10 airlines ending in a Chapter-11 process have been approved to exit, so SAS is staying in that flow! Next out is a reconstruction process for SAS AB ( SAS mother company) in Sweden. This will take considerable shorter time than the 621 days under Chapter-11. If all go according to SAS flightplan after exit Chapter-11, the reconstruction in Sweden and regulatory approval by EU, should be finalized by end June. Job well done by all parties involved, though the Chapter-11 process turns out costly for SAS, maybe up to $200m to advisors, lawyers and others! https://lnkd.in/d5cSzmeq

SAS reached a new milestone today as the C11 court i New York approved new owners and funding plan. The troubled scandinavian airline is progressing on its flightplan to exit C11 proceedings. Today (21NOV) the C11 judge approved the new owners/Consortium ownership structure in «New SAS», Castlelake 32%- DK State 25,8%-AF/KLM 19,9%-Lind Invest 8,5%, and their prorata investment of $1,2bn, split in cash and convertible debt. Next waypoint on SAS flightplan is debt to equity convertion process, the target is to convert minimum SEK20bn in debt to equity. It will also be expected from the new owners/Consortium to update on when the SAS share is planned to be delisted from stock exchanges in Scandinavia. It has been indicated during Q1 2024.

NEW: The FCA's LTAF is the UK’s answer to broadening private markets access to retail investors, but this structure is only part of the solution, Travers Smith funds partner William Normand has argued. "The LTAF is a UK-specific answer to a UK-specific problem, but it is not the beginning, middle and end of the story. It would be foolish and ruling out quite a lot of the market to think private assets access equals the LTAFs," he said.  Wealth manager demand for private assets has resulted in a new range of products beyond the traditional feeder structures, with Luxembourg's semi-liquid or evergreen funds the current dominant model for alternative asset managers.
