It's worth noting that while Simon Cole argued that there's a difference between "similarity" and "exactly alike," this does NOT mean that Cole agrees that fingerprint identification is 100% reliable. = = = Simon A. Cole has used the notion of the “fingerprint examiner’s fallacy” to describe the mistaken idea that the individual uniqueness of fingerprints could ever be taken as a guarantee of the accuracy of fingerprint identification. As Cole explains, When asked by courts for proof of the “reliability” of forensic fingerprint evidence, fingerprint examiners answered that all fingerprint patterns are unique. Courts failed to grasp the gap in logic between the two statements and uniqueness became enshrined as the foundation of the accuracy of forensic fingerprint identification… We continue to labor under this fallacy today [5]. Cole’s point is that the uniqueness of fingerprints and the accuracy of fingerprint identification are two completely different questions. The ability to match a fingermark discovered at a crime scene with a fingerprint taken from a suspect is a complex process relying upon multiple levels of observation, analysis, and interpretation. Whether or not fingerprints are unique to the individual (in a general sense) tells us nothing about how the identification process is carried out and whether or not it is done accurately and reliably. = = = https://lnkd.in/gqNriZtg

What is conditional release? And what does it mean for employers? This term is often referred to as probation or parole. But overall, it means releasing a person from a correctional facility with the expectation that they will obey certain conditions. If they don’t, that person will be reinstated in prison. But here are some lesser-known realities about conditional release: ➡ It varies *alot* depending on the individual and their circumstances. ➡ It’s identified as a major contributing factor for recidivism (aka: rearrest). ➡ It poses significant challenges to employers who are actively hiring justice-involved workers. FreeCap Financial, Inc’s Data Science Lead, Jordan Brown, goes into detail on the connection between Conditional Release and Second Chance Hiring on his Substack this month. His article is definitely worth a read.

One in three Americans has a criminal record. Even after these individuals pay their debt to society, many face significant challenges finding meaningful employment. Addressing barriers to employment can help pave the way to a second chance for millions of individuals, and businesses can play a pivotal role. One of our funders, JPMorgan Chase & Co., has long been a vocal and visible advocate for this work. This year, they commissioned an art installation at Independence Mall of 38 statues, made from the legal paperwork that serves as a barrier to people with records in states that have yet to enact Clean Slate legislation. Clean Slate creates a process to automatically clear eligible records, giving more people a second chance at opportunity. We all have an important role to play in driving change – and we are proud to partner with JPMorgan Chase & Co. all year long to make an impact in our communities. Sometimes issues seem so complex, but are really just about basic humanity and dignity. Providing people with a second chance is one of those issues. For the last five years JPMorgan Chase & Co. has supported efforts that help remove barriers to employment and opportunity for the millions of Americans who have a criminal record. The repercussions for those who have fulfilled their obligations to the justice system and get caught in never-ending barriers to reentering society are devastating. The toll on economic growth alone costs the U.S. over $80 billion annually, but it’s about so much more than that. The complicated paperwork and high costs required to expunge these records is preventing far too many American’s from accessing some the most basic needs: jobs, housing, education and other resources needed to take care of themselves and their families. This Second Chance Month, we’re raising awareness around the 38 states that have yet to enact Clean Slate legislation, a critical step needed to remove these barriers and create greater economic opportunity for more people. Please take two minutes and watch this video and join this effort. We need to fix this.
