🎆Did you copy my AI-generated image?🌇 | Images that are produced by #AI-generative technology are not the product of human authorship and thus not protected by #copyright. Under US law, a work may be registered if it qualifies as an « original » « work of authorship ». Courts have limited this phrase to the creations of human beings with the US Copyright Office following suit. As such, the latter will not register works produced by a machine or mere mechanical process that operates randomly or automatically without any creative input or intervention from a human author. So even if you provide the AI tool with a series of descriptive text prompts, you do not actually form the generated images and are not the author. Whilst the information in the prompt may influence the generated image, it does not dictate a specific result. It is not the same as editing tools such as Adobe Photoshop whereby artists select what image or other visual material to modify, choose which tools to use and what changes to make and take specific steps to control the final image which is produced. Even if you go on to change an AI-generated image, the change must not be too imperceptible to supply the necessary creativity for copyright protection. The new work must contain a sufficient amount of original authorship to itself qualify for copyright protection. In a similar fashion, under UK copyright law, a work must be « original » to attract copyright protection and whilst there is no express provision requiring the creator to be human, the work must exhibit the creator’s « personal touch ». However, unliked in the US, UK copyright law expressly provides for copyright protection of computer-generated works that do not have a human creator. In these circumstances, the author of such a work is « the person by whom the arrangements necessary for the creation of the work are undertaken ». Nevertheless, the work still needs to be this person’s own intellectual creation. The task, therefore, becomes: who is the author? The concept of human creation is critical (potentially outdated?) and the question remains whether it can be replaced with the concept of creation by our creations | #copyright #AI
