Do you read every contract before you sign it? For many businesses, contracts are a key element in ensuring their best interests are at the forefront of any relationship. However, we frequently see that not all parties are reading the terms of the relationship that are laid out in business agreements. I have to admit, it is pretty easy to simply skim over an agreement, especially if you know the other party well, but is that really the best choice for your business? It is always possible for either party to intentionally (or unintentionally) incorporate language that does not benefit your needs. In addition, understanding all elements of a contract allows you to make informed decisions not only about your business relationship, but also when it comes to your business and its success. Stating what your services don’t include is just as important as stating what they do include. Part of being on the same page is eliminating as many assumptions as possible. When it seems like the solution you offer and the potential client’s problem are a glove fit, we don’t always ask clarifying questions or maybe we let the excitement of moving forward take over or maybe we just don’t know to ask certain questions. And that’s ok. We’re human, we move like that sometimes. But as the service provider.. the expert.. the one that knows what you offer better than anyone else.. it’s your job to make it clear what your services don’t include especially if it could change the mind of your client. How can you do this? Easy. Wherever you list what your services include, simply list what they don’t include. (You can base this list of don’ts from questions clients have asked in the past, confusion you’ve had to clear up about your services or things you think your clients would assume from the nature of the type of work you do) Pro tip: Don’t just leave it on the sales page, put it in the contract too. It is good to trust people, but that trust should not stop you from entering into a formal contract with people once you choose to do business with them because there are a million stories out there of how people change after entering into a business relationship. Also, the fact that you choose to formalize your contract does not mean that you do not trust the party you are contracting with. It simply means that you are being professional. An executed contract basically reminds parties of their obligations and how they are meant to perform them. Trust me, people often forget or misconceive what was agreed orally so the contract does not only serve as evidence of contract but also a good way of clarifying or reminding parties of their obligations in the contract. It is also important that you get a lawyer to review all your contracts no matter how briefly worded they are before you sign because one wrong word inserted in a contract can affect your entire fortune.
