For those of you in the #ai, #diagnostics, #blockchain, and software space considering protecting your innovation with patents, there is some light on the horizon. Recently Senators Thom Tillis (R-NC) and Chris Coons (D-DE) introduced the Patent Eligibility Restoration Act of 2023, bipartisan legislation to amend Section 35 USC 101 to clarify patentable subject matter by explicitly listing the types of inventions that are ineligible for patent protection. Notably, the proposed legislation provides that any process that cannot be practically performed without the use of a machine (including a computer) shall be eligible for patent coverage, thereby categorizing certain software as patent eligible. While ambiguity with respect to patentable subject matter has not been eliminated by this Act, it certainly appears to be an improvement over the current landscape of outdated statutory language and vague Supreme Court decisions. IPlytics just released an interesting (and detailed) report on 5G. The overall conclusion is that 5G ownership has become increasingly fragmented, with an ever-growing number of companies becoming SEP-holders. However, the report also lays out more nuanced observations, such as China's increasing role in SEPs as well as a sharp increase in declared patents for NB-IoT (a low power network that can be used for indoor smart devices, among other uses). As both the quantity and variety of licensors and licensees continue to expand, FRAND negotiations will need to similarly evolve.

On Monday, the Council for Innovation Promotion sent a letter to the Senate Judiciary Subcommittee on #IntellectualProperty in support of #PERA: "We write to express our strong support for the Patent Eligibility Restoration Act of 2023 (PERA), S. 2140, and to applaud the subcommittee's commitment to this #legislation with its holding of a hearing on the bill, 'The Patent Eligibility Restoration Act – Restoring Clarity, Certainty, and Predictability to the U.S. Patent System' on January 23, 2024. Witnesses on each of the hearing's two panels made a compelling case for the need to pass this legislation to provide incentives for #investment and #research in cutting-edge #technologies such as medical #diagnostics, #biotechnology, computer-implemented #inventions, blockchain, and #artificialintelligence (AI). As most witnesses agreed, reform is needed — not only to benefit Americans' quality of life, support new innovation, new businesses, and good jobs — but to also maintain American competitiveness with our economic competitors, who routinely grant #patent protection on these technologies." Yesterday Nokia issued SEP infringement proceedings against Verifone in the UPC and in Germany claiming that some cellular and Wi-Fi patents are infringed by Verifone’s point of sale payment devices. This perhaps marks the beginning of a new phase of litigation relating to SEP licensing in the IoT space. Issues will come to the fore again about whether suppliers have SEP licenses and/or were refused a license by SEP holders, and whether SEP holders can refuse to grant SEP licenses, or whether that refusal infringes competition laws. The UK courts have recently been clear in saying that SEP holders should grant licenses to any company that wants a SEP license, and that’s perhaps why proceedings weren’t brought in the UK. With this new wave of litigation, companies selling IoT connected products would do well to check with their suppliers whether their suppliers have the SEP licenses for the connectivity functionality. Of course this will raise complex issues in the supply chain for those negotiating pricing, warranties and indemnities - a nightmare for SMEs particularly - but that’s the challenge and problem with the current SEP licensing regime.
