On March 25, 2024, the European Commission introduced new Regulatory Technical Standards (RTS) - Commission Delegated Regulations (EU) 2024/911 and 2024/912 - and Implementing Technical Standards (ITS) - Commission Implementing Regulations (EU) 2024/910 and 2024/913 - regarding cross-border activity notifications for Alternative Investment Funds (AIFs) and Undertakings for Collective Investment in Transferable Securities (UCITS). The EC may adopt the RTS with the amendments it considers relevant or reject it. The European Parliament and the Council may object to an RTS adopted by the EC within a period of three months. Background On December 2023, ESMA published its final report on the draft technical standards under the revised ELTIF Regulation and submitted it to the European Commission for adoption. Today, European Securities and Markets Authority (ESMA) published their Final Report on revised technical standards for passporting. ESMA’s proposals include targeted amendments to the existing RTS and ITS that would add new information requirements to the list of details #investment firms have to provide at the passporting stage. A new investment services and activities passport notification will also provide National Competent Authorities with additional information on a firm’s planned or existing #crossborder activities. #investorprotection #funds #assetmanagement #mifidii
