His insights will provide much needed clarity, especially during these uncertain times where job security is a top concern. Myth or Fact? 🤔Employees can sue their employers for “wrongful dismissal” if insufficient reasons were given and only the contractual notice period was provided. IT ALL DEPENDS! If misconduct or poor performance is cited as the reason for dismissal, the employer bears the burden of proof. Dismissal is considered wrongful only if an employer is unable to do so. For poor performance, if there is documented proof and the employer terminates with notice, the dismissal is not wrongful. Misconduct is the only legitimate reason for dismissal without notice, however an employer must conduct due inquiry before dismissal. In the case of Low Pu Tong v Housing and Development Board, the Court found that no disciplinary proceedings were conducted, and awarded three months salary considering the time taken to conduct disciplinary proceedings. „Why do you serve #alcohol at #Christmas and #office #parties?” This is what our Palestinian Legal Trainee asked me when we were discussing various recent cases of #sexual and other #harassment at the #workplace. Now that the holiday season is over, sadly, we can at least discuss the topic. I really like a glass of good red wine. But almost all cases of #sexual #harassment, of #physically #aggressive behavior at the workplace which we have been investigating lately during #internal #investigations did evolve out of a situation where drinks were part of the program. One incident took place at the #Oktoberfest (which I also love, see photo), where drinking beer is more or less the main aim. Many employers in and outside of Munich organize a company table. While this can be a nice event, it can also go off the rails very quickly. We were investigating a case that included both sexual harassment and an ensuing fist fight among male colleagues (!). Some lawyers will recall a similar incident at a German law firm some years ago... Another incident took place at the #Christmas #party of a Munich startup a while ago. In that case, I was supporting one of the victims on the employee side. The bizarre situation at Munich startup Finn has been described very precisely in an article by Christina Kyriasoglou in manager magazin. The Managing Director, obviously seriously drunk at the Christmas party, was #harassing #various #women (nine, in fact, according to Manager Magazin) both verbally and physically. Yet it took some time before he was dismissed. So, to come back to the initial question – alcohol is curse and blessing at the same time, making our office parties more fun, but also more liable to derail. Given his own cultural background, our Palestinian Trainee described how amazed he is at the liberal use of alcohol in German public and private life. So, should we forbid it at office parties? I don’t think so. But we should have structures in place where odd behavior is being observed while it happens, where victims – often female – know where to turn to during the event, where allegations can be noted and verified. The recent German implementation of the #EU #Whistleblower #Directive is a step towards creating such internal structures.

The reality of female power in politics in Taiwan: the election stories of four female legislative candidates Taiwan has the first female president in the Chinese world and the highest proportion of female legislators in Asia. The upcoming election is approaching, and DW interviewed four female legislative candidates from different political parties and generations to gain insight into the gender issues in Taiwan. One candidate, Zeng Baiyu, chose to run despite feeling unsuitable for the role due to her introverted nature. She has previously participated in social movements and politics, and now she is the Democratic Progressive Party's first female legislative candidate in the "deepest blue constituency in Taiwan." While family offices play a critical role in facilitating the transition of wealth, management, and values across generations within families, an integral part of managing a family’s wealth and business affairs is implementing family governance structures, processes and policies to ensure that family members are aligned in their objectives and values.
