Any physician who has ever worked within a hospital setting certainly understands the delicate balance that must be maintained in this often tense and stressful environment. Providers in hospitals must focus not only on risk management and compliance, but “getting along” with those around them and not becoming the subject of unwanted (or unwarranted) scrutiny by one’s own peers and colleagues. Sound familiar? Simply staying out of trouble and avoiding adverse actions is not as easy as it used to be. Not only has managed care continue to monopolize healthcare, but laws, regulations and guidelines have only grown in scope. Workplace behavior that was tolerated 10 years ago can now be grounds for termination from the medical staff due to “disruptive” behavior “affecting the safety of patient care”. “Disruptive” is unfortunately often applied subjectively. Do you know and understand the bylaws at your hospital? Do you understand the scope of legal immunity afforded to hospitals for peer review actions? Do you understand the scope of due process that you are entitled (or not entitled) to under the hospital bylaws? Do you understand the guidelines for reporting to the state licensing boards or the National Practitioner Data Bank? Do you understand the connection between adverse actions at hospitals and involvement/investigation by the state licensing board?
