Google to Face £13.6bn Lawsuit Over Online Advertising Google will face a £13.6bn lawsuit accusing it of having too much control over online advertising. This decision comes from a UK court, allowing the case to go to trial. The lawsuit is led by Ad Tech Collective Action LLP, which claims Google’s actions have cost UK online publishers money. Claudio Pollack, from Ad Tech Collective Action, said this ruling is important for those hurt by Google’s behaviour. Google’s legal director, Oliver Bethell, called the lawsuit "speculative and opportunistic" and said they will strongly defend against it. The case is about advertising technology (AdTech), which helps decide what ads people see online and how much publishers get paid. Ad Tech Collective Action says Google promotes its own services over competitors', leading to lower earnings for publishers and high fees. Following the launch of its investigation into Google relating to its conduct in the digital advertising technology market in May 2022, the UK's Competition and Markets Authority (the CMA) has provisionally found that Google is abusing its dominance in open-display ad tech. From at least 2015, the CMA considers Google to have exploited its position through the operation of both its buying tools and publisher ad server, in order to strengthen and protect AdX. This was found to be essentially self-preferencing its own services. AdX is the Google-operated ad exchange which sits at the centre of the 'ad tech stack'. Google will have an opportunity to put forward its representations in response to the findings before a final decision is made. This conduct is understood to be ongoing by Google. "Whilst it may be a while before we see a final decision on the case (with consideration of representations not expected to conclude until December 2025), parallel investigations underway by the US Department of Justice and the European Commission may add to the picture."
