In our Seal of Inclusivity (SOI), we require that any recommended product have “low fees and flexible payment models, and provide an equal value exchange.” But what does this look like in practice? If we follow the rules that the largest debit network owners have established, that Cannabis is a controlled substance and federally illegal and as such POP Debit cannot be supported on their networks, then let's examine 21 U.S.C. 853 Criminal forfeitures (see link below). If they insist on such, then ATMs located within dispensaries whether MCC 6011 (Cash) or MCC 6051 (Cashless) are facilitating Cannabis transactions as well. Those firms will be responsible to surrender income earned under the interchange fees acquired. It is doubtful that any of the ATM transactions defined above, have followed FINCEN guidance and AML/BSA along with SARS work has equally been performed on any level including periodic examinations which alone further complicates matters.
