I specialize in Employment Law, HR Advice, Workplace Consulting and Compliance, and Workplace Litigation
Here are THE five biggest workplace-related misconceptions I continue to hear about over and over again from business owners: 1. "We don't have to pay overtime since they are on salary!" 2. "We are a small business. So, we don't need to comply with the law." 3. "No one has ever complained/sued us/audited us. So, we are fine (i.e. in compliance)!" 4. "He/she wanted to be a 1099. So how can he/she/the government now claim he/she was a W-2?" 5. "We will countersue because this is a frivolous claim!" There are many more, but these are the most common ones I have heard over the years and continue to hear today. #HR and #employmentlaw counsel, care to add anything to the list? #employmentlaw #laborlaw #workplacelaw #TheWorkplaceLawfirm

Make a plan ‘right now’ for $55K #Overtime rule, attorney says "It’s time for human resources professionals to devise a plan for coping with a potentially drastic increase to the Fair Labor Standards Act’s overtime threshold, a Cozen O’Connor attorney said Thursday. Employers should consider “right now” how they would tackle a change that could increase the FLSA’s regulatory salary threshold for overtime eligibility from about $35,000 to about $55,000, Mariah Passarelli, member of the firm, said during a virtual conference. The U.S. Department of Labor proposed that change in August and is accepting stakeholder comments through Tuesday."
