On redundancy, in Kalume v Action Africa Help International (Employment and Labour Relations Cause 689 of 2019) [2024] KEELRC 992 (KLR) (11 April 2024) (Judgment), the Respondent admitted that it had equal and similar positions to be filled and were in fact filled after the Claimant had been declared redundant. However, prior to her termination, it had required the Claimant to apply for those positions like other external applicants. The court held that the Respondent lacked a valid reason to terminate the Claimant on account of redundancy because there was work to be done by her in the organization. By failing to transfer the Claimant to the other available roles, the Respondent did not engage in meaningful discussions with the Claimant to preserve her employment and minimize the effects of the separation. Things you need to know about ArcelorMittal Liberia Imagine ArcelorMittal Liberia is deducting ( USD 15.31) from each employee's salary monthly as the United Workers Union of Liberia, (UWUL) due payment. Disgustingly, #UWUL is a union that has been brought by the management of ArcelorMittal Liberia, and the union has negotiated employees' rights and reduced honest advocacy from their Leadership of the so-called Union. Whereas, Employees pay their monthly due for quality welfare and don't achieve legal representation, or financial assistance after job termination to proceed with any legal case against company Management, among other claims. It has come to our attention that employees' rights are tempered illegally due to infringed policies or procedures from the management COO and some high-level staff against Many Liberians on the Job. The ArcelorMittal Liberia Company Management has failed to execute many things within the #COLLECTIVE #BARGAINING #AGREEMENT, CBA, and only a few have been done as been told in the preliminary process in promoting the (ADR), Alternative Dispute Resolution Division of the Ministry of Justice. I also have in my procession the CBA copy and employee statements in line with their utterances. This agreement between the Union and the company will expire on #July 31 2024. More facts we have that ArcelorMittal Liberia is not committed to their employee's Agreement and illegally Terminating three ( 3) employees in recent times without using the company rightful procedure. Saywon Konneh is one of the Terminated staff who was illegally dismissed from their Job. Victims' lawyers will be filing a complaint soon and requesting a conference with the company, while we will engage the government authorities, Advocacy groups and media partners about bad Labour practices against many Liberians within said company name mentioned above. Did you know that the #MsikabaBridge contract participation goals (CPG) for targeted enterprises (#SMMEs and suppliers) is a minimum of 30% of the contract value (R1.65 billion)? To date, R553.2 million (107% of the target) has been spent on 157 targeted enterprises, which comprise 44 suppliers, 52 service providers and 61 #subcontractors. R92.8 million has been spent on wages of local targeted labour, which is 108% of the 5% CPG target (R86 million). On non-compete/ restrictive clauses, in Mwaura v Taxify Kenya Limited (Cause 173 of 2019) [2023] KEELRC 1849 (KLR) (27 July 2023) (Judgment), the court observed that an employer who is found to have unfairly terminated an employee’s employment automatically loses the right to enforce a non-compete clause on such an employee.
