The National LGBTQ Bar recently co-sponsored a webinar titled, “Creating More Welcoming Workplaces for Nonbinary Individuals | Practical Steps Towards Gender Inclusion in the Legal Profession.” The panel, which included Andy Izenson, D Dangaran, August Hieber, Rafael Langer-Osuna, and Rebekah Tobison Scherr, discussed their experiences as nonbinary legal professionals and shared the impact of “Creating More Welcoming Workspaces.” This trailblazing new guide, published by Beyond Binary Legal and the Harvard Law School LGBTQ Advocacy Clinic, outlines how and why the legal profession must uplift, support, and respect nonbinary people. Just wrapped on a panel today, titled, "Creating More Welcoming Workplaces for Nonbinary Individuals" with D Dangaran, Rebekah Scherr, Rafael M. Langer-Osuna, and Andy Izenson, sponsored by the American Bar Association, the ABA Commission on Sexual Orientation and Gender Identity, Harvard Law School LGBTQ Advocacy Clinic, Beyond Binary Legal, NALP, the National LGBTQ Bar Association, and the National Trans Bar Association. I echoed the urgency to act that I want us all to consider and feel: with this onslaught of anti-trans legislation getting introduced, challenged, and upheld around the country, there will be more trans and nonbinary court users, served by more trans and nonbinary court personnel, and represented by more trans and nonbinary attorneys, all affected by the sting of systemic transphobia. What is our collective plan to make our legal spaces SAFE, welcoming, and affirming for people like me and my community? Small steps towards this make our systems more accessible for all. I am honored to join Richard Saenz from Lambda Legal, D Dangaran from Rights Behind Bars, Jeanne LoCicero from ACLU-NJ, Lisa Burke from the AOC and others this Saturday, March 2, at the annual LGBTQ Legal Update where we will discuss the growing anti-trans climate in our country and state. This reality is evidenced by the more than 460 pieces of anti-LGBTQ legislation that have been introduced in state legislatures across the country in the first two months of 2024, most aimed at transgender, non-binary and gender non-conforming people. But the crisis is not limited to legislation. There remains a continuing need to understand the fragility of equality under the law for people who are transgender, non-binary and gender non-conforming and the relevance of these issues across legal practice areas. Today marks a monumental day in the journey towards equality and justice. We celebrate the anniversaries of three landmark U.S. Supreme Court decisions that have profoundly shaped LGBTQ rights in America: Lawrence v. Texas (2003) - Decriminalized consensual adult same-sex sexual activities, recognizing the right to privacy and dismantling harmful stigmas. United States v. Windsor (2013) - Struck down the discriminatory Defense of Marriage Act (DOMA), ensuring federal recognition of same-sex marriages and equal protection under the law. Obergefell v. Hodges (2015) - Legalized marriage equality nationwide, affirming that every couple deserves the right to marry. These rulings are a testament to the tireless efforts of activists, allies, and advocates who have fought for dignity, respect, and equal rights. As we honor these victories, we also commit to maintaining them, as well as continuing the quest for full equality and justice for all LGBTQ people.

Professor Susan Keller participated in a panel at the Association of American Law School's Annual Meeting in early January. The panel was entitled, "Legislative Attacks on LGBTQ Equality." Professor Keller's talk examined the way that the rhetoric of recent legislation prohibiting participation by transgender women in women's sports teams perpetuates false narratives about gender. The talk was based on an article Professor Keller has authored that is forthcoming in the Nevada Law Journal: Doing Things with the Language of Law and Gender: Using Speech Act Theory to Understand the Meaning and Effect of the Gender Identity Backlash. #WesternStateProud #WesternState #Law
