🏡Terminology Tuesday🏡 Title insurance is a type of insurance that protects real estate owners and lenders against financial loss due to defects in a property's title. A property title is a legal document that provides evidence of ownership and the right to use and occupy the property. Title insurance helps ensure that the property owner has a clear and marketable title. When a property is bought or mortgaged, a thorough examination of its title history is conducted to identify any potential issues or defects, such as outstanding liens, encumbrances, errors in public records, or unresolved claims. Despite a careful search, some hidden issues may still exist. Title insurance is designed to protect against these hidden risks and provide financial coverage in case a problem arises after the property is purchased or mortgaged. There are two main types of title insurance: 1. **Owner's Title Insurance:** This protects the property owner against financial losses resulting from title defects. It is typically purchased at the time of property acquisition and is valid for as long as the owner or their heirs have an interest in the property. 2. **Lender's Title Insurance:** Lenders often require borrowers to purchase this type of title insurance to protect the lender's interest in the property. It covers the outstanding loan amount and is usually required as a condition for obtaining a mortgage loan. In the event of a covered title issue, the title insurance policy will provide coverage for legal fees, settlement costs, and financial losses up to the policy's face value.
