Remember we were all concerned with our Tuna being 'Dolphin Safe"? This is the same thing, but with Data. If IBM's 'net' (all the data we use to train AI) catches a Dolphin (proprietary IP) or a dolphin-shaped tuna (spurious legal complaints), then it will cover the damages. Simple, everyone is saying that. IBM is going a little bit further by protecting customers from the "Slippin' Jimmy"'s of the world by publishing their foundation model data (sort of), essentially raising the bar for a legal challenge from "AI stole & sold my Idea!" to "...the training data in tables 9.3a, 14.45t & 88.1j includes 3 lines that, when taken together, infringe upon..." Which benefits everyone buying or selling AI. Smart move.

Interesting. This article supports what I have preaching for months. Ensure your AI platform of choice has mature governance and governance audit tools to allow you to manage financial, repetitional and business risks. IBM told us weeks ago that were going to offer legal protections with their data models and vetted tools under WatsonX brand. What I found interesting is Microsoft and Adobe are now also offering customers legal/copyright protection of sorts. In all of these, the fine print will be interesting to read. What governance do either of those tools have, how will you provide evidence of the training models and data sets used or your ability to parse out bias, hate, etc? None that I know of. They do not even a governance model for their AI's. Offering protection from lawsuits will be more difficult when you have no governance reports to showcase what data, models and tools you used and how they were trained. Interesting that security is an after thought for most companies. #IBM #WatsonX is the only AI out there bringing robust, mature governance - even vetted models they guarantee and protect you with out of the box. Generative models that go off the rails can leave businesses exposed to embarrassment, legal liability, and everything in between. If you are going to use generative AI in your enterprise and rely on the content it generates, you need to know what kind of data your foundation models are trained on and mitigate the risks that come with using these models. That’s why IBM “will assume the legal risk of businesses that use its A.I. systems and will publish the technology’s underlying data.”
