𝐀𝐝𝐝𝐫𝐞𝐬𝐬𝐢𝐧𝐠 𝐭𝐡𝐞 𝐑𝐞𝐚𝐥 𝐂𝐡𝐚𝐥𝐥𝐞𝐧𝐠𝐞𝐬 𝐢𝐧 𝐂𝐚𝐥𝐢𝐟𝐨𝐫𝐧𝐢𝐚'𝐬 𝐑𝐞𝐚𝐥 𝐄𝐬𝐭𝐚𝐭𝐞 𝐚𝐧𝐝 𝐇𝐨𝐦𝐞𝐥𝐞𝐬𝐬𝐧𝐞𝐬𝐬 𝐂𝐫𝐢𝐬𝐢𝐬 The recent ruling by the #California Supreme Court to block the Taxpayer Protection and Government Accountability Act from the November ballot underscores a critical juncture for California's real estate market. By maintaining the status quo, the decision effectively allows local measures like #ULA to continue imposing tiered transfer taxes, which many argue could hinder the recovery and growth of our real estate sector amidst an already fragile economy. This ongoing situation highlights not just a market in distress but also a missed opportunity to recalibrate essential tax laws that directly impact property investment and development statewide. Moreover, the city's approach to tackling the growing homelessness crisis through substantial financial allocations—without corresponding results—raises concerns about the efficacy of current strategies and the urgent need for reevaluation. Despite billions spent, #LosAngeles, for example, continues to struggle with increasing homelessness, suggesting that throwing money at the problem without a strategic, outcome-focused plan will only perpetuate the cycle of waste and ineffectiveness. For real estate professionals and city planners alike, this serves as a call to action to advocate for policies that not only stimulate economic growth but also address social challenges effectively. We must push for solutions that combine fiscal responsibility with innovative social programs, ensuring that every dollar spent moves us closer to resolving both the housing shortage and homelessness crisis in a sustainable manner.

Huge increases in property tax bills have become a crisis for many households, especially seniors and those in lower income neighborhoods. The increase is mostly due to a combination of factors, including a historic rise in property tax valuations, school levies, and local levies (but not county-wide levies). Homeowners can seek assistance by contacting Cincinnati-Hamilton County Community Action Agency, Hamilton County Job and Family Services, and Legal Aid Society of Greater Cincinnati. Contact your state legislators and ask what they can do to provide both immediate and long-term relief. Here are some options: 1) More funding for immediate property tax assistance. 2) Address the unconstitutional funding of schools through property taxes. 3) Increase the homestead exemption to $50K and have the exemption amount increase automatically in future years based on property valuation increases (not inflation). https://lnkd.in/e_CWVPgk Thanks to LISC Greater Cincinnati for hosting an informative webinar this morning on this issue. #homeownership #generationalwealth #housing #propertytaxes #advocacy

What is so special ** about 'vested' interests? Following on from last week's post, a related issue often comes up in the context of how wills are crafted. In particular, wills often provide that a gift to a beneficiary is subject to the person not having already 'died or dying before attaining a vested interest'. The decision in Serwin v Dolso [2020] NSWSC 370 explores this phrase in some detail.
