On April 23, 2024, the U.S. Department of Labor (DOL) issued a final rule raising salary thresholds for certain overtime exemptions under the Fair Labor Standards Act (FLSA). In essence, the rule raises the minimum salary threshold an employee must be paid to be exempt from overtime. This means that possibly millions of employees will no longer be exempt under the FLSA and will be entitled to receive overtime for all hours worked over 40 hours in one workweek. Being paid a salary does not automatically exempt an employee from overtime rights. Many employers mistakenly believe that paying someone a salary automatically makes the employee exempt from receiving overtime pay. The reality is that many salaried employees are entitled to overtime under federal and state laws, regardless of their job title or pay structure because they don’t meet the exemption test (making at least twice the minimum wage, and duties that are exempt). Don't let misconceptions keep you from receiving the compensation you deserve. Know your rights and seek guidance if you have questions. #overtime #overtimerights #hourly #salary #employees #myth #fact #employmentlaw #employment #law #employmentlawyer #CAemploymentlaw #lawyer #attorney #legal #california #employer #business #humanresources #hrnews #work #humanresources #hrmanagement #smallbusinessowner #smallbusiness #entrepreneur #businessowner #management
