The Information Commissioner's Office has just published guidelines on preventing harm in the housing sector, in relation to personal data ranging from contact details to health records: https://lnkd.in/gFYzE68e Housing societies implement CCTVs, collect phone numbers, contact details and the relationship shared between visitors and residents, often maintained digitally for record maintenance / security purposes. Housing societies also maintain a range of information collected from residents themselves, including CCTV footages within shared spaces. While housing society compared to bigger technology companies may appear to be innocuous in the grand scheme of things, the sheer nature of personal data accessible to housing complexes and its intimate nature makes their processing important or significant from a regulatory perspective. With the enactment of India's new data protection law, housing societies will need to consider the relevant ground for processing data, and where consent is required, consider whether appropriate notice and consent mechanisms are in place. Where visitors seek to withdraw their consent / erase data with housing societies, questions on how long this information can be retained / who can access such data / who does the information relate to, and under what conditions will become increasingly relevant. To what extent is visitor data 'publicly available'? Will the exemption for investigation and non-compliance apply? There may be conflicts between residents / resident and housing administration / as well as visitors on what data should be maintained and stored. The purposes and conditions in which resident and visitor data can be collected and stored need to be carefully considered. Is data pertaining to the visitor the personal data only of the visitor or does it also in some ways relate to those residing in the community, may also warrant some food for thought. Residents may feel a strong interest in knowing who is visiting their community spaces. Staff training, controls on the collection, sharing and disclosure of resident as well as visitor data become important considerations. While there is no record maintenance requirement under India's new law, towards demonstrating compliance on a bad day, maintaining accurate records would be crucial as well. https://lnkd.in/gNv_nxiw
