On Oct. 26, 2023, the National Labor Relations Board (NLRB) announced a final rule that establishes new criteria to determine joint-employer status. Joint employment situations can happen when two or more employers share personnel hiring, supervision and management practices. When a joint employment status exists, joint employers are equally responsible for compliance with applicable laws and regulations. A recent decision in the Employment Court highlights that strictly adhering to a contractual approach when interpreting employment agreements may not always be in favour of businesses. The case involved an employee of Fonterra, with a 15-year tenure, who was denied long service benefits by the company as he had spent much of his tenure on an individual agreement and at a higher level of seniority. The employee fought the company’s interpretation of the collective bargaining agreement and won. Although the details of the case may not seem noteworthy, Tompkins Wake Partner Daniel Erickson says, the findings were significant for employers and pointed to a way the Employment Court is heading in such disputes, where broader concepts within the Employment Relations Act need to be taken into consideration.
