Just in case you missed the memo... Here's a chart of E3, E3D, and E3R approvals from 2006 through 2023. While some may argue that the significant drop in numbers in 2023 may be attributed to a 4c drop in the $AU from $US0.70 to $US0.66, it is important to note that 2022 also saw a drop from $US0.71 to $US0.68 and the two record years for E3 approvals corresponded with a fall of 11c from $US0.81 in January 2018 to $US0.70 in December 2019. So, how do you explain a 15% drop in E3 and a nearly 18% drop in E3R visas when the US is experiencing low unemployment, posted record GPD, and Visa Appointment wait times in Australia are at record lows? He was told that the E2 investment was not substantial and that the E2 business was marginal We reviewed his application documents. The plan was prepared by a professional business plan writer and the application was prepared by an immigration lawyer in the USA . Although an E2 owner of an LLC is paid out of profits and does not receive a salary, the tables below that were submitted in the plan are very misleading for E2 examiners . It would be very easy for an E2 examiner to conclude that the E2 owner will receive no compensation for 5 years . We have come across this situation quite often. We have seen denials when the E2 plan showed no compensation in year 1 but very significant compensation in future years. E2 examiners quickly focus on marginality issues if they are given the opportunity. Please work with you E2 lawyers and E2 Business plan writers to present owner compensation projections that will address marginality issues.
