I recently signed my Power of Attorney and Healthcare Proxy here at Lamson & Cutner! Advance directives are legal documents that provide instructions for medical care and other essential tasks that the chosen agent is legally able to perform for their loved one. These documents benefit more than just the geriatric population. It is far too common to hear about court battles over a person’s intent once an individual becomes incapacitated. I have ensured that if for any future reason I am unable to make my own medical decisions, my Healthcare Proxy will be able to act on my behalf. A Power of Attorney and a Health Care Proxy are crucial documents for every adult. Your Health Care Proxy is only effective if you can NOT express your wishes yourself. It names an Agent who knows what your wishes are and who is empowered to carry them out. Otherwise it may be a doctor who is a complete stranger to you who is making life-or-death decisions about your care. The Power of Attorney is effective immediately - but only if your Agent has an original or a certified copy. You may be young and at your physical peak - but if you bonk your head skiing, or get knocked over by an e-bike and are out of commission for weeks, your POA can do everything you can't or don't feel like doing while you're recovering.

I lived in Maine - the state with the highest population of elders in the nation - for 13 years and saw firsthand just how important a Health Care Proxy can be. Thank you so much for sharing this important post (and reminding me to update my own!)
