This week the Supreme Court will hear argument in Devillier v. Texas, which asks whether a person whose property is taken without just compensation may file suit to enforce the Takings Clause even if the legislature has not provided a cause of action to do so. The answer is yes, as explained in a brief that I had the privilege of filing on behalf of Duke Law Professor Ernest Young, a leading expert on federal courts. Among other things, the brief explains why the modern conception of a "cause of action" is at odds with the Founding Era-understanding of what it took to bring a lawsuit. Worth a read for fed courts, con law, or legal history nerds.
