A valid arbitration clause will prevent excessive litigation. I am excited to see a clear commitment to requiring parties to exhaust alternative dispute resolution before going to court. Respecting parties' autonomy is essential, and the New York court has once again affirmed this principle in this case. It is important to ensure that arbitration clauses are upheld by the judiciary. Lawsuits directed toward arbitrators have been on the rise, but thanks to a new Arbitration Bill, this could come to an end. The bill is set to protect these professionals from 'unreasonable lawsuits ' by modernising the Arbitration Act 1996. With the new U.S. Supreme Court term kicking off today, in the sixth installment of his The National Law Journal “Arguing Class Actions” column, Founding Partner Adam Levitt discusses the hypocrisy of the High Court’s veil of “textualism” in the framework of arbitration clauses and class action waivers. “Textualism fades before the altar of economic opportunism and litigation advantage,” Adam writes. While consumers are usually unaware of hidden arbitration clauses in the fine print of more and more purchase, employment, or loan agreements, “these clauses silently dismantle a cornerstone of our justice system and deny ordinary citizens the right to seek redress in the court of law.” As “more people climb Mount Everest each year than win consumer arbitrations,” Adam outlines a path forward for consumers faced with “the poison pill” of an arbitration clause.
