The Subcommittee on Capital Markets — which is part of the House Financial Services Committee — recently held a hearing that featured testimony from several individuals who discussed the U.S. Department of Labor’s proposed Fiduciary Rule, focusing on the implications for retirement savings and access. Among the witnesses who spoke at the hearing was my Faegre Drinker colleague Bradford Campbell, who addressed the DOL’s proposed regulatory package redefining fiduciary investment advice under the Employee Retirement Income Security Act — otherwise known as ERISA. #Fiduciary #DOL #ERISA #Retirement #Investment #FinancialServices

Top thing on my mind this afternoon: It is funny how when you hear about something, you start to see articles related to that topic. Case and point: claiming lost retirement savings. A big problem a couple years ago, when everyone and their dog was changing jobs, was the leave-behind of retirement plans. The DOL looked to correct this with a "lost & found" database. The goal of the database was "planned to use data that plan administrators submitted to the IRS on their Annual Registration Statement Identifying Separated Participants with Deferred Vested Benefits." However, the ERISA Industry Committee (ERIC, because why wouldn't an acronym be derived from another acronym...) said the requirement of information needed to be put into this database was a bit of an overreach. You can read more about this in the attached article but it's something we heard from Caitlin Lam & Jonathan Fredman, AIF®, CRPS®, CPFA during their retirement seminar tour a couple of weeks ago as well. https://lnkd.in/gqtcXQZM
