Harassment can extend to unwanted contact outside of the office, even if it appears to be innocent at first blush. The employment tribunal have recently found that a line manager’s decisions to send a birthday card to an employee on long-term sick leave (who had asked not to be contacted except in work-related emergencies) amounted to an instance of harassment. Of course, this must be understood in the wider context of the case, but it is worth employers and managers considering critically how an employee might view contact outside of the office, especially if wider circumstances make it likely that such contact will be unwelcome or seen as hostile or demeaning. https://lnkd.in/eSM6QRiY #Gannons #employmentlaw #londonlawyers

What happens if a worker with 17 years’ service is terminated for serious and wilful misconduct? After 10 years continuous service, long service must be paid in full of employment on termination. However, where a worker has completed 5 years (but less than 10 years) of service, they would only be entitled to a long service pro-rata payment if they resigned on account of illness, incapacity, domestic or other pressing necessity; or they are dismissed for any reason other than serious and wilful misconduct; or the termination occurred as a result of the death of the worker.
