The EU has introduced a powerful new legislation, the European Deforestation Regulation (EUDR), aimed at curbing forest degradation. Effective from June 29th 2023, with compliance required by December 30th 2024, the EUDR enforces strict penalties for non-compliance. Unlike directives, which allow member states flexibility in achieving legislative goals, regulations are rigid and take effect immediately upon approval. This makes the EUDR a potent tool in the fight against deforestation, as it applies uniformly across all member states without the need for specific national measures. The European Commission is proposing to delay its enforcement by one year. WHY is environmental law needed? 1. Implementing the decisions made at the United Nations Conference on Human Environment held in Stockholm. 2. Creation of a government authority to regulate industry that can issue direct orders including closure orders. 3. Coordinating activities of different agencies that are operating under the existing laws. 4. Enacting regular laws for the protection of the environment. 5. Imposing punishments and penalties on those who endanger the environment, safety and health. For each failure or contravention, the punishment includes a prison term of up to five years or a fine of up to Rs. 1 lakh, or both. This can also be extended for up to seven years in cases. 6. Engaging in the sustainable development of the environment. 7. ⚖️ Effective due diligence legislation can drive real change on deforestation. This #IntlForestDay 🌴, we need action from the UK government 🇬🇧 - getting the secondary legislation promised 2 years ago before Parliament. The UK Environment Act isn’t perfect. Due diligence laws need to include: 🏦 The finance sector, 🪵 All deforestation, not just illegal deforestation. 👥 Tackling human rights abuses should be part of the law, 📦 and it should include more commodities, not be limited to just 4.
