There is a lot of talk about the new Aged Care Act and implications for consumers and providers. Rightly so - this is part of a MEGA Reform agenda and the implications are enormous. Two small observations to the side… 1. It is striking that, for all the talk of 'rights' there is little to hold the Australian Government Department of Health and Aged Care (as 'System Governor') accountable for ensuring a system that delivers equitable and accessible aged care services… everyone else is held accountable- providers with civil and criminal penalties- but no one is accountable for delivering a system that works 2. There is also provision for automated decision-making with nary a parameter or framework to be seen.... Has the government learnt nothing from #Robodebt? BREAKING: West Northamptonshire Council become 53rd I've just had an overwhelming moment with emotional happy tears in my eyes reading back the cabinet report at West Northamptonshire Council Conservative led council who passed Protected Characteristics for Care Experienced People last night. This feels so right and people are getting it... It's not about increasing stigma, it's not going to be stigmatising. It's about using established mechanisms to reset the care system so we have voice in policy. I found this paragraph by Cllr Fiona Baker (Conservative Lead Member for Children); The Video is "I am Louise a 24 year old care leaver" In summary, recognising care experience as a protected characteristic is a transformative approach. It not only enshrines the support for care-experienced individuals in law but also integrates this support into established mechanisms that public bodies are already familiar with. This ensures that supporting care experienced individuals is not an add-on, but a fundamental aspect of policy development and decision-making. The approach guarantees that policies are developed with equity in mind, ensuring that care experienced individuals have the support and opportunities they need to thrive.

The proposed civil and criminal penalties for aged care providers are causing a stir and for good reason. The proposed new Aged Care Act introduces penalties that could see aged care provider directors, executives and a wide range of managers facing up to five years in prison if they breach their (rather ambiguous) statutory duties. This harsh approach risks driving away talented professionals and creating an environment of fear rather than improvement. What if there was a better way? The proposed amended banning order regime already allows the Aged Care Quality and Safety Commission to weed out bad actors, ensuring that only those committed to high standards of care can operate. This tool is a more appropriate and effective tool for maintaining quality without the draconian measures proposed in the new Act. My latest article in Business News Magazine explores why leveraging the existing banning order regime is the smarter choice for enhancing accountability while supporting the sector’s stability. It is personally frustrating to see the numbers keep rising. However, I do believe at least one element driving that factor is employee reporting more regularly now. As a career professional in this field and constant, one of the most effective tools an organization can employ is independent program assessment. As a former director of a law enforcement organization “operational gap blindness” is a very real thing. Our gaps become operationalized and if not causing a major issue at the time, they become a part of the normal workflow. Left unchecked they will become stumbling blocks to an organization’s success.

It's encouraging to witness an increasing number of states prioritizing this issue, actively bringing it to the forefront, and demanding measures aimed at planning and prevention. The inaugural Workforce Violence Prevention Summit held at the Georgia State Capitol addressed the escalating issue of violence against healthcare workers, with Mary Chatman, Georgia Hospital Association board chair, emphasizing the unacceptability of such acts. Co-hosted by the GHA and Georgia Nurses Association, the summit facilitated collaboration among law enforcement, legislators, state leaders, and healthcare professionals to tackle workplace violence. Statistics from the American Nurses Foundation revealed a significant rise in verbal abuse, while a Press Ganey analysis underscored the alarming frequency of physical assaults. Representative Matt Reeves outlined the Safer Hospitals Act aimed at enhancing penalties for assaults on healthcare workers, with commitments from both associations to intensify efforts in eradicating such violence.
