The statutory interpretation canon dictating that exemptions from taxation are strictly construed against the taxpayer is frequently used by the IRS in order to enforce their own interpretation of the tax code on all those subject to taxation. Interesting discussion in Tax Notes about the scope and implications of the Supreme Court’s ruling in Corner Post Inc. v. Federal Reserve. “A claim accrues when the plaintiff has the right to assert it in court — and in the case of the APA, that is when the plaintiff is injured by final agency action.” As the article highlights, this ruling might have significant implications in the tax world. But not only this ruling, Judge Kavanaugh commented in his concurrence that the remedy for a successful APA challenge is vacatur. About this, David W. Foster comments, “Courts that invalidate Treasury regulations should set them aside not just for the person bringing the APA challenge, but for all purposes.” This result seems reasonable especially for Regulations that have defects ab initio that render them invalid, such as the failure to comply with the notice-and-comment procedure. https://lnkd.in/gnWZSqaW
