July 17, LONDON - Fashion label #ThomBrowne and athletic wear giant #Adidas (ADSGn.DE) recommenced their legal war on Wednesday, with #London's High Court hearing the most recent round of a worldwide dispute centered on their rival striped #trademarks. #Adidas was sued in #London in 2021 by #ThomBrowne, a #New York designer who frequently uses a four-bar stripe pattern, to remove various #trademarks that featured #Adidas' well-known three-stripe design. #ThomBrowne contends #Adidas is essentially attempting to create a monopoly on the use of stripes on clothing, having abandoned a three-bar design in 2007 in response to #Adidas' complaints. Adidas, on the other hand, is countersuing Thom Browne, alleging that it is abusing Adidas' good name and brand image by selling leisure and sportswear with four stripes, in violation of its #trademarks. Additionally, Thom Browne is suing Adidas separately under different trademarks in the Netherlands and at the #European Union Intellectual Property Office. Thom Browne's #attorney, Philip Roberts, said that Adidas had exploited certain trademarks as "Trojan horses" to stop other companies from using stripes on their products, while the company's creator watched on in court. "The breadth of #Adidas' asserted monopoly threatens the basic freedom of fashion designers to design clothing in the manner they wish," Roberts further stated in court filings. Charlotte May, an attorney for #Adidas, however, stated in court documents that Thom Browne's 2020 sportswear line debut was a turning moment that "strikes at the heart of the #Adidas business".
