On July 4th, Canada’s Minister of Innovation, Science and Industry released a statement governing direct acquisitions of control of “important Canadian mining companies” by non-Canadians that exceed the prescribed monetary threshold. The upshot being that such transactions will receive the Minister’s approval under the “net benefit to Canada” test only “in the most exceptional of circumstances”.    In this blog post, our Competition/Antitrust & Foreign Investment Group explains the implications and why this could have a chilling effect on foreign investment in Canada’s critical minerals sector. A wonderful two days at The London Indaba 2024, with Peter Leon and Greg Mulley each chairing panels and contributing to discussions about investing in critical resources and #mining in Africa.
