Last month, the FDA sent out their weekly Enforcement Report and highlighted 24 personal care products that were recalled and have now been classified as Class II risks due to benzene contamination. Product types included dry hair conditioners and shampoos, mists, and spray deodorants, but benzene contamination is a serious risk for many skincare, cosmetics, sunscreen, and other personal care products. Benzene is a known human carcinogen that can cause leukemia and other blood disorders and contamination is regulated in the US and many international markets. Products with thickening agents, isobutane, and other hydrocarbon ingredients tend to be the most at risk for contamination and recalls. Sunscreen ingredients like oxybenzone, octinoxate, and avobenzone are absorbed into the body with just a single application and can persist on the skin and in the bloodstream for weeks. Additionally, there are increasing concerns regarding the potential endocrine-disrupting effects of some chemicals found in sunscreens, including homosalate, avobenzone, octinoxate, and oxybenzone, which could interfere with hormone function. Based on current data, the FDA categorized only two sunscreen ingredients as safe and effective: zinc oxide and titanium dioxide. They don't significantly permeate the skin. Twelve ingredients, including avobenzone, octinoxate, and oxybenzone, lack enough data to be generally recognized as safe and effective. (COSMETIC) PRODUCT CLAIMS !! Most know you have to be careful on the claims that you make on your cosmetic packaging such as your unit carton and primary packaging. Did you know you also need to be careful on the claims you make on your website, your advertising, and even the claims your influencers are making? The FDA is checking all of this. The FT&C Act does not recognize any category such as a 'cosmeceuticals'. What is your risk? Certain claims can make your cosmetic product now a drug product as defined by the FDA. However, you didn't manufacture it per FDA OTC Drug requirements. You are now non-compliant with drug gmp's. What are some examples? 1. Hair regrowth is a drug claim 2. Increases the production of collagen is a drug claim 3. Reduces rosacea is a drug claim 4. Aromatherapy claims such as a fragrance making a person sleep better is a drug claim 5. Lemon, a powerhouse of vitamin C…with its antibacterial properties - is a drug claim What could be a consequence? 1. FDA Warning Letter 2.
