CSRD Integrated into Danish Law 🏛️ We knew it was coming, and today marks the day when things got real, as we are soon halfway through 2024 and the first reporting year for CSRD ⏳ Today's integration of the CSRD into Danish legislation marks a significant shift in the reporting landscape across Denmark as key legal updates include the incorporation of the CSRD into the Auditors Act, Companies Act and Danish Financial Statements Act with the ESRS meeting the requirements of Danish Financial Statements Act §99a 📑 Now that CSRD are officially into Danish law, the eagerly anticipated updates to the implementation guidance from EFRAG can not come soon enough 🌱

In 2023, finally, three cases of relocation of functions were decided by German courts: The first judgement was from the Fiscal Court of Lower Saxony dated 16 March 2023 (10 K 310/19), the second one was decided by Germany’s highest tax court, the Federal Fiscal Court dated 9 August 2023 (I R 54/19), the third judgement was also from the Fiscal Court of Lower Saxony which has, however, not yet been published. In the latest edition of the International Transfer Pricing Journal, my colleague Dr. Susann Karnath and I discuss the recent case law on the German relocation of functions rules and the practical implications for multinational companies with regard to the legal situation before and after the revision of the relocation of functions rules in 2022. Exciting developments ahead in the realm of competition law! As per the National Budget 2024-2025, amendments are forthcoming for the Competition Act regarding rights of appeal before the Supreme Court of Mauritius. The Competition Act will be amended to, henceforth, allow for an appeal before the Supreme Court against any ruling, decision, order or direction of the Competition Commission. Section 67(1)(a) of the Competition Act presently provides for a right of appeal to the Supreme Court against an order or direction of the Competition Commission only. In the absence of any definitions of the terms “order” and “direction” in the Competition Act, the Supreme Court has recently held that that appeals under section 67 are limited to an order or direction of the Competition Commission, as expressly provided for in the Competition Act, and would not include any decision of the Competition Commission, such as a decision to stay proceedings for abuse of process, which is neither an order nor a direction under the Competition Act. Under the Competition Act, the Competition Commission is empowered to make an order imposing a financial penalty on, or to give directions to, any enterprise in prescribed situations after due process, in response to restrictive business practices. The proposed amendments broaden the scope of the right of appeal to encompass decisions and rulings of the Competition Commission, which possesses adjudicative powers. #MauritianCompetitionlaw #LegalUpdates #NationalBudget2024-2025
