EU ETS: further important implementation regulation published: As expected by OceanScore and most industry experts, the implementation act on defining the responsibility between ship managers and owners has now been passed. The act is balanced and thought through, putting final responsibility onto the owner of a vessel but allowing for the (in many cases practical) delegation of this responsibility to the DOC holder. This clarity was urgently needed - as without it, neither ETS clauses in shipmans nor the resulting commercial arrangements had a sound legal basis. Let's hope that related issues like the charter parties fall in place soon - we only have 40 days left before EU ETS enters into force! What is still missing? From a regulatory perspective, the definition of islands excluded from EU ETS is really important. Commercially speaking: shipmans and charter parties. Practically: Setting up trading accounts and securing access to EUA market places / brokers / traders. And, of course: Defining efficient processes within the managers / owners as well as the respective responsibilities for the different steps needed to manage one's ETS exposure. Starting in January, the EU ETS will extend to all ships entering, leaving, or operating in EU waters. This cap-and-trade system sets decreasing emission limits for companies. They must monitor emissions, independently audit them, and purchase EU allowances (EUAs) to offset their carbon emissions, aligning with EU's environmental goals.
