 European Commission launches infringement procedure against Hungary over its divergent interpretation of the ECT Executive summary:  The European Commission launched an infringement procedure against Hungary in July 2024 for its unilateral interpretation of the Energy Charter Treaty (ECT) following the Komstroy judgment, which contradicts the EU consensus. The ECJ ruled that the ECT's arbitration clause doesn't apply to intra-EU disputes. However, while 26 EU Member States reaffirmed this position, Hungary argued that this should only change after a formal amendment of the ECT. The Commission maintains that Hungary's position violates EU law and has given Hungary two months to respond.
