NY STATE HOUSING DEAL in the new NY State Budget is a compromise- The new Property Tax Incentive for real estate developers to construct affordable housing in NYC is the "485-x" program. It is the heir to the 421-a program that expired in 2022. 485-x has more affordable programs and sets forth new labor standards. The deal established “good cause” eviction protections for resi tenants by capping rent increases on covered apartments at the lower of 10% or 5% plus the consumer price index. Landlords may evict tenants who violate their lease, cause a nuisance, or if the Landlord plans to take the unit off the market. The Good Cause legislation does not affect tenants in co-op and condo rentals, apartment buildings with 10 or less units, and those in “high-rent” units, with rent higher than 245% of the federally-set fair market rent. Good Cause Eviction is is here but in many cases it may end up leading to higher rents and not lower rents. Although they are still finalizing the legislation, we are starting to get a sense of the basic framework of the legislation. The deal includes a version of “good cause eviction” and replaces the property tax break 421a. It also extends by six years the construction deadline for projects under the previous 421a program, which expired in 2022.

Municipal Monday..... This week we'll discuss Oak Park. The seller of property in Oak Park is required to purchase real estate transfer tax stamps before a property transfer can be completed. Transfer stamps are $8 per thousand, or fraction thereof, of the full actual contract price. An exempt stamp for a non-sale transaction requires the original deed, signed and notarized along with the statement by grantor and grantee. The fee for exempt properties is $30.
