Good idea Emma Pond. It is also about digital safety and the blurring of personal and professinal behaviours, where things often go wrong. When we vent, whinge, or talk about others in disparaging ways on any online platform, there’s risk of it being discoverable through OIAs, someone taking a screenshot, shoulder surfers, falling into the wrong hands, etc. It speaks to the need to have regular (and positively phrased) ‘digital safety, privacy, staff ethics, and company values’ chats and workshops as part of a healthy safety and wellbeing culture. How many orgs do this annually? Or, a couple of times a year, as part of their culture building, given staff turnover etc? A good example and reminder, thanks Emma Pond. SIMPLE DOCUMENTS MADE FROM COMPUTERS ARE NOT COMPUTER-GENERATED DOCUMENTS TO SATISFY SECTION 84 by Branham Chima. (judicialpoetry.com) The law is settled that for any evidence generated by a computer to be admissible in evidence, it has to comply with the provisions of Section 84 (2) of the Evidence Act. See Dickson v. Sylva and Ors (2016) LPELR-41257 (SC). Exhibits SN1 and SN2 comprises of statement of account, invoices for services rendered and dispatch notes. These are documents that were produced from a computer, but do they qualify as computer-generated documents simply because the tool used in their production is a computer? The answer is an emphatic No. Simple documents made from a computer which do not have to go through complicated data processing and online communication with another or other computing device(s), such as letters, reports, affidavits, Court processes, etcetera, are not computer-generated evidence that must satisfy the conditions stipulated in Section 84 (2) of the Evidence Act before they are admitted in evidence. Therefore, the invoices, dispatch notes and statement of account are not computer-generated evidence that must satisfy the conditions in Section 84 (2) before they can be admissible. I am fortified on this view by the recent decision of the Supreme Court in Attorney-General of the Federation v. Anuebunwa (2022) LPELR-57750 (SC), where the Court held: “These documents are three original letters and one original affidavit. These are not computer-generated documents. The wordings of Section 84 of the Evidence Act 2011 do not contemplate that before an original official letter is tendered and admitted in evidence, the party tendering same must satisfy the conditions in the provision. Neither does the provision envisage same where the admissibility of an original affidavit is in issue. It would be ridiculous to assume that a document which was typed using a computer is a computer-generated document. For example, it is the algorithm or data imputed by a Bank Officer into the bank's database that generates the various information on the statement of account of a customer. That Bank Statement is a computer-generated document which has to be certified by the officer to ensure that no one illegally or without authorization tampered with the source data as officially imputed in the computer. Also, the certification must include that the computer was operational or in good working order when the document was generated." per M.I. Sirajo JCA. BUA Int'l Ltd V. A video example of link analysis using five previous Detroit Police Department employees named in a recent lawsuit. Defendants include: Detective Moises Jimenez Commander James Talbert Detective Kurtis Staples Sergeant Eddie Croxton Officer Alma Hughes-Grubbs Developing an informational database on alleged official misconduct by law enforcement (LE) protects all parties involved, including LE, and potentially saves taxpayers millions in avoided lawsuits. On June 28, 2023 charges were filed against the city of Detroit and five former employees of the Detroit Police Department for their 2005 involvement in the wrongful conviction of an innocent man. A powerful tool is the development of a centralized repository, where information can be collated and analyzed. One advantage to centralizing information is the availability of data to link individuals and documents together. The below video will provide a visualization to the beginning steps in developing an informational database and link analysis on five named defendants in a lawsuit against the Detroit Police Department. Legal stuff: There is a presumption of innocence in our legal system. All five defendants are innocent until proven guilty. All five were allegedly involved in official misconduct that resulted in the conviction of an innocent man. All information was obtained using Open Source Intelligence (OSINT) tools. I have not been hired in any capacity, as a PI or otherwise, to research this case. I have not obtained any information, using paid databases, available to me as a licensed PI in my research.
