🌍 Climate Litigation is Evolving: What Does it Mean for Companies? The Grantham Research Institute on Climate Change & the Environment's latest report on climate change litigation highlights key trends from 2023. Here's what caught our attention at Human Level: ⚖️ Innovative Legal Strategies: More climate cases are using human rights arguments, with just transition cases focusing on both mitigation and adaptation measures, and green vs. green cases examining trade-offs between climate actions and other environmental goals. 🔍 Increasing Numbers: Between 2015 (the year the Paris Agreement was adopted) and 2023, around 230 strategic climate-aligned lawsuits have been initiated against companies and trade associations, with more than two-thirds of these cases emerging since 2020. 🏢 Implications for Companies: No sector is immune from lawsuits. Companies must conduct robust human rights and environmental due diligence when designing and implementing climate measures to improve their preparedness for legal challenges. Climate litigation works! 💠 Climate lawsuits are increasingly used to push governments and corporations for more decisive climate actions. 💠 Landmark cases, like those against the Dutch and German governments, have led to significant policy changes and commitments to reduce greenhouse gas emissions (and the same might happen because of the ruling last week (https://lnkd.in/eEAgp8nq). 💠 Even when climate lawsuits fail, they can raise public awareness and influence future legal and policy outcomes. 💠 Litigation against corporations often results in financial repercussions and motivates better environmental disclosures to avoid reputational damage. 💠 Future climate litigation will likely focus on compensation for climate-related damages and ensuring governments meet their commitments to mitigate climate effects. I think it would be better if governments and companies respected our laws and that litigation was unnecessary. However, since it is clear that this is not the reality that we live in, I am grateful that we have NGOs, activists, and citizens who go to court. https://lnkd.in/ew8Sztpm
