The European Court of Human Rights (ECtHR) has played a crucial role in addressing the fragmented legal recognition of same-sex couples across Europe. In his latest blog, EIPA expert Carlos Santaló Goris highlights that, while Western Europe largely embraces same-sex marriage, many Eastern European countries still lack formal recognition. Recent ECtHR judgments, including five in 2023 alone, are pushing for changes, requiring states to provide legal status to same-sex couples. This evolving approach highlights the Court’s commitment to human rights, fostering greater equality and recognition for same-sex couples throughout Europe. The Gender Recognition Act 2004 states that, once a person has legally changed their gender and obtained a Gender Recognition Certificate, their acquired gender becomes their legal sex. Therefore, a person cannot be legally recognised as female by gender but male by sex. The Act aligns their legal sex with their acquired gender for most legal purposes.
