Did you know that fraud is the most common offence in this country, amounting to 41% of all crime in the year ending September 2022? Employees of companies and other organisations can commit fraud in a wide variety of ways – for example, by dishonest sales practices, hiding important information from consumers or investors, or dishonest practices in financial markets. Individuals, other businesses, or the taxpayer may end up defrauded and out of pocket as a result. (taken from gov.uk) Join myself, Chris Stott and Ruth Paley for this Failure to prevent fraud Masterclass looking at both practical and legal responses to help your organisation protect themselves. Details to book below.
On 7 November, join Partner Ruth Paley and Principal Associate Chris Stott from our Corporate Crime and Investigations team, together with Cifas, for a joint masterclass on the upcoming “Failure to Prevent Fraud” offence which is now law. Make sure you understand specific risks and new compliance requirements for your business. The masterclass will look at how and when the offence may be used by enforcement authorities. It will also examine practical steps organisations can take to engage senior stakeholders, put in place "reasonable prevention procedures" and manage exposure to fraud risk. Impacting companies, by holding them accountable for fraud by associated persons and could directly affect Directors and Officers (D&O) insurance. The law encourages robust anti-fraud measures, with potential fines and reputational damage. It’s even important for firms based overseas, who could be prosecuted if UK victims are involved. Companies should be prioritising fraud prevention and creating a strong anti-fraud culture to avoid penalties. For more details the topic, check out the full article via the link in the post below. ⬇️
