A great article from the Lockton Management Liability team tackling failure to prevent. The new law, as part of the Economic Crime and Corporate Transparency Act 2023, targets fraud prevention. Impacting companies, by holding them accountable for fraud by associated persons and could directly affect Directors and Officers (D&O) insurance. The law encourages robust anti-fraud measures, with potential fines and reputational damage. It’s even important for firms based overseas, who could be prosecuted if UK victims are involved. Following our representations, the Crown Prosecution Service has directed that the rape investigation started in 2021 against our client, a young man of good character, should be closed with no further action.
