COBRA Fees Adjusted for Inflation in FY2024 Customs and Border Protection (CBP) published in a July 28 Federal Register notice outlining adjustments to certain customs user fees and corresponding limitations established by the Consolidated Omnibus Budget Reconciliation Act (COBRA) for Fiscal Year 2024. The Merchandise Processing Fee (MPF) ad valorem rate of 0.3464 percent will NOT change. The MPF minimum and maximum for formal entries (class code 499) will change. The minimum will change from $29.66 to $31.67; and the maximum will change from $575.35 to $614.35. Some other fees that are changing for customs brokers include the Surcharge for Manual, Formal Entry/Release (class code 500) changing to $3.80 and the fee for Informal Entry/Release, automated and not prepared by CBP personnel (class code 311a), becoming $2.53. ACE AND ACI ....... ACE (Automated Commercial Environment) and ACI (Advance Commercial Information) are both systems related to customs and border management, but they serve different purposes and are associated with different countries. ACE (Automated Commercial Environment): Country: United States Purpose: ACE is the U.S. Customs and Border Protection's (CBP) trade processing system. It facilitates the electronic submission of import and export data, streamlining the customs clearance process. Functions: ACE handles various trade-related activities, including entry and entry summary filings, tracking of cargo, and communication between traders and customs authorities. Key Features: It aims to enhance trade efficiency, improve security, and ensure compliance with U.S. customs regulations. ACI (Advance Commercial Information): Country: Canada Purpose: ACI is a program implemented by the Canada Border Services Agency (CBSA). It requires the electronic transmission of advance information on goods before they arrive in Canada. Functions: ACI enhances border security by allowing CBSA to assess and identify potential risks associated with incoming shipments before they reach the border. It applies to various modes of transportation, including air, marine, and highway. Key Features: ACI helps expedite the customs clearance process and enables CBSA to focus on higher-risk shipments, contributing to improved border management. In summary, ACE is specific to the United States and focuses on streamlining trade processes, while ACI is a Canadian initiative primarily aimed at enhancing border security through the advance submission of information on incoming goods.

How can Customs Administrations avoid similar catastrophic incidents - which in this particular case has led to $23M of daily revenue loss? 1) High Availability (HA): traditionally speaking, high availability of IT systems is perceived by many as a luxurious non-functional capability. However in case of sensitive, critical systems affecting cross-border movements of cargo or people, HA must be supported and enabled with top priority. 2) Business Continuity: no matter how highly-available your Customs/Border Management System is (or is not), there must always be a clear business continuity plan to follow in case of such emergencies/downtimes. 3) Transparency: the fact that for several hours, no single government agency took enough ownership to announce the problem, and communicate its impact/mitigation to the affected trade industry; reveals lack of effective intragovernmental coordination and governance. National Customs systems are complex by nature - due to many factors such as the diverse nature of its stakeholders/scanrios, and the different partner government agencies typically involved in cargo clearance. We can make those systems slightly less complex by addressing obvious aspects like the ones above.
