Our work and efforts are not always quantifiable. However, if I´m particularly proud of something, that is the results we have so far achieved with my dear colleague Britta Kynast, ČAK - Česká advokátní komora and the CCBE in the EU Rule of law framework when it comes to the legal profession because what seems to be taken for granted now seemed impossible then. 🔑Five years ago, I presented a contribution, regarding the inclusion of the legal profession in the EU policy aside from judges and prosecutors, at the Uni conference, which was then used as a basis of our long journey which started to materialise only now and there is still work to be done. No one was disputing (also based on the jurisprudence of European courts and the Venice Commission checklist) that lawyers play a vital role in the administration of justice. However, when dealing with concrete policy in the justice area, the legal profession was not mentioned as an indispensable part. In concrete legislative proposals, its independence and core principles, which create the essential basis for the work of lawyers (mainly professional secrecy), were and still are often overlooked. 🔑To explain this, I used the parallel from the research of Petra Bard, regarding the comparison of "Rule of Law" and "Rule by Law", in other words, the difference between democratic and totalitarian systems and how this translates into concrete policy even if the system remains democratic, but political priorities are elsewhere. 🔑Why I am mentioning this now is, that I participated in the EDPS - European Data Protection Supervisor European summit last week, where among the other distinguished speakers Rebecca Richards (US) mentioned the same parallel in the context of overall data protection and state surveillance activities, which goes far beyond the protection of confidentiality of lawyer-client communication and is extremely brave. 🏹 She wasn´t the only one with similar views, so my point is, if we are to accept this wider perspective of data protection in the context of emerging risks of open data society and training AI, there is no way we can further justify the breaches of professional secrecy of lawyers in both national and EU policy-making. Why? Simply because the legal advice and representation come in place when the citizens are already facing difficult situations in life which require expert opinion they cannot obtain otherwise and the protection of being able to discuss this with an expert confidentially is the prerequisite of the existence of effective advice and mutual trust.
