Throughout consultation, work an overwhelming theme has presented itself and requested by defense counsel; exploiting the gaps in the investigative process. Basic questions on thoroughness of documentation, application of scientific methodologies, and accuracy of findings. For 20 years, I asked my students to repeat or answer a specific question: “ did you do a thorough search the crime scene?” at which point we could very accurately pick a part their answer. I would also ask my students to finish this statement: “ if it’s not in your report it………” didn’t happen of course is the response. However, every detective knows that when they are assigned a case file, they literally have to dig into it to understand what happened because the report is vague at best. It is tragically the easiest thing to exploit on the thoroughness of searching a crime scene. Equipment, resources, manpower, and support are all limiting factors. However, there is a sequential process for working the scenes and the information that has the potential to be uncovered. Often times the search will not yield any results, but the fact that the officer took the time to look forward, shut down the defenses argument on whether they took the time to look for it. It short, I, the investigator, took these steps to attempt to locate. Not performing those steps, opens the doors to the accuracy of. I will elaborate: defense, “Did you do a thorough research of the crime scene?”, “Yes”. “Did you do this…… Technique?”, “No”. “ so is it possible that there is evidence that shows that someone else was involved and or the possibility that something else occurred?” The reasonable answer is yes. “ so I ask again, did you do a thorough search for the crime scene?” This exploitation factor alone allows for that one to have the opportunity to doubt the credibility of the investigative process and can severely limit the effectiveness of the prosecution.
